Use of City Symbols and Logo

Candidates are prohibited from using or altering the City of West Kelowna’s logo, city colours, graphics, or any other item of City intellectual property for any campaign-related purposes. This includes, but is not limited to, signs, printed and electronic publications, flyers, brochures, e-mail, website, business cards, postcards, letterheads, leaflets, posters, fridge magnets and promotional items.  The City of West Kelowna acts as a neutral party, ensuring fairness and transparency to effectively conduct the 2022 General Local Election and will not endorse or support the use of our City symbols used by candidates.

Signs may be posted during the campaign period so long as the placement complies with Sign Bylaw No. 0250. Signs must not obscure travel lines of vision nor obstruct cyclists, pedestrians nor traffic. Signs must not obstruct access to businesses, emergency vehicles or property. Signs cannot be placed within 100 metres of a voting location on the day of voting. Placement of signs

We strongly encourage all candidates to be mindful of sign placement on city property in order to avoid additional damages to shallow underground utilities. Please ensure your team provides extra care when installing signs on city right of ways. Signs in these areas should be installed at least 2 feet off the edge of sidewalk, curb or grass to avoid damage to irrigation. Please refer to the reference photo of damage to irrigation from a sign.

 

 

 

 

 

 

 

 

Temporary Election Signs on Public Property

In order to ensure the safety of our community and property, yet allow candidates in the municipal election campaign to make use of public space for election purposes, the City of West Kelowna has set out the following requirements for placement, management and removal of election campaign signage within our City boundaries:

GENERAL REQUIREMENTS

  • Sign permits are not required;
  • Signs cannot be placed within 100 metres of a voting location on the day of voting;
  • Signs must meet the requirements of the Local Election Campaign Financing Act;
  • Elections signs for municipal or school trustee elections are permitted at 9am on the first day of the nomination period and must be removed no later then Sunday, October 16, 2022; and
  • Signs must be removed no later than the day after the election vote.  

SIZE OF TEMPORARY ELECTION SIGNS 

Temporary election signs are permitted in accordance with the following: 

  • Small signs, less than 1 m in height and 0.5 sq m in area are permitted on public road right of ways, including landscaped areas/planting beds, providing they are in accordance with the prohibitions below. 
  • Large signs, up to 2 m in height and 2 sq m are permitted on public road right of ways providing they are not installed in landscaped areas/planting beds and in accordance with the prohibitions below.

GENERAL PROHIBITIONS

 Signs are prohibited on:

  • Medians and traffic islands, and in planting beds;
  • Boulevard trees, or within one (1) metre of a boulevard tree;
  • All City facilities or structures, parks, and playing fields, including the adjoining boulevard area.

Signs are prohibited on public or private property that:

  • Are within one (1) metre of a fire hydrant;
  • Obstruct or detract from any traffic control device or signage;
  • Obstruct the line of vision at an intersection; or
  • Are placed in a manner that may constitute a hazard to pedestrians, cyclists or vehicles.

GENERAL ENFORCEMENT

  • Signs installed in prohibited areas will be removed by City staff if not removed within reasonable notice to the applicable candidate or campaign office as determined by the City. 
  • Where there are immediate safety concerns or damage to municipal property, City staff will immediately remove the signs and then contact the candidate or campaign office.
  • The City will assume no responsibility for any damage to election signs where they are removed by city staff in prohibited locations.

ADDITIONAL CANDIDATE RESPONSIBILITIES

  • Any damage to underground utilities or services because of election signs being placed on municipal property is the responsibility of the candidates and their agents.
  • Candidates and their agents are liable for any damage done to City property in placement of election signs on municipal property.
  • Candidates and their agents should also reference applicable Provincial and Federal statutes and regulations for additional requirements.

  • Completing the application form in-person at City Hall, 2760 Cameron Road

Mail Ballot Package Distribution

Mail ballot packages will be provided to voters as soon as possible after the ballots are printed. 

You can select one of the following options to receive your mail ballot package:

  • Pick up your mail ballot package in person at City of West Kelowna City Hall, 2760 Cameron Road
  • Arrange for someone else to pick up the mail ballot package on your behalf from City Hall
  • Mail it to a residential address via regular Canada Post delivery
  • Arrange and pay for, the package to be mailed via a courier service from City Hall
 Returning your Mail Ballot Package
You are responsible for ensuring that your completed mail ballot package is received by the Chief Election Officer no later than 8:00 p.m. on General Voting Day, Saturday, October 15, 2022.
  • Please note: Deadline to receive ballots, via mail, is Friday, October 14, 2022. Mail is not delivered on Saturdays.
  • Drop off in person at West Kelowna City Hall: You may have someone drop off your mail ballot package, on your behalf, to West Kelowna City Hall during regular office hours (Monday through Friday 8:30 a.m. – 4:30 p.m., excluding holidays, up to Friday, October 14, 2022).
  • Secure Drop Box outside of West Kelowna City Hall: The Chief Election Officer will also accept mail ballots through the secure drop box (look for the labelled drop box sign) outside of City Hall until 8:00 p.m. on Saturday, October 15.

The City of West Kelowna makes every effort to ensure polling stations are accessible.

  • Curbside: If you find that a polling station is difficult to access, curbside voting is available. Simply ask another voter to inform election staff of your need for assistance and election staff will bring your ballot to your vehicle.
  • Translation services: If you require an interpreter, please bring one with you to the polling station.
  • Support while voting: If you are unable to mark your own ballot, you may ask a relative, friend or election staff to assist you.

  Am I eligible to vote?
West Kelowna Residents

You are eligible to vote as a resident elector if you are:

  • 18 years of age or older on voting day
  • A Canadian citizen
  • A resident living in British Columbia for at least six months before voting (April 14, 2022)
  • Not disqualified from voting due to an election offence
  • Not ineligible to vote for other reasons such as elections offences

West Kelowna Non-Residents

You may vote as a non-resident elector if you:

  • Are 18 years of age or older on voting day
  • Are a Canadian citizen
  • Are not a resident in the City of West Kelowna
  • Are not ineligible to vote for other reasons such as elections offences
  • Have lived in British Columbia for at least six months before voting (April 14, 2022)
  • Have owned property within the City of West Kelowna for at least 30 days before voting (September 14, 2022)
  • Have written consent from the majority of the property's co-owners to vote as the non-resident elector:
    • Proof is required using the Non-resident Elector Consent Form
    • Bring the form to the polling station when voting; or, obtain the form from the polling station and return to vote with the completed and signed document.
 How to register to vote?

The City of West Kelowna uses same-day voter registration. Voters do not need to register in advance to vote in the City of West Kelowna General Election.  

West Kelowna Residents

  • Register to vote at the polling station on voting day.
  • You must provide two pieces of identification, one with a signature, that confirms who you are and where you presently live.

West Kelowna Non-Residents

  • Register to vote at the polling station on voting day.
  • You must provide two pieces of identification, one with a signature, that confirms who you are and where you presently live.
  • You must provide written consent from the majority of the property's co-owners to vote as the non-resident elector:
    • Bring the completed and signed Non-resident Elector Consent Form when you arrive to vote at the polling station; or obtain the form from the polling station and return to vote with the completed and signed document. 
 Examples of acceptable identification include:

Voters must present at least two (2) pieces of acceptable identification at the voting station that show proof of identity and place of residence. At least one of the two forms of ID must contain a signature.

  • BC Driver's License
  • BC Identification Card
  • BC Services Card (BCID)
  • Another card issued by the Government of B.C. or Canada that shows your name and address
  • Credit Card
  • Debit Card
  • Canadian Passport
  • Property Tax Notice
  • Certificate of Canadian Citizenship
  • Government-Issued Military Identification Card
  • Firearms Possession and Acquisition License
  • Certificate of Indian Status
  • Current utility bill containing Elector's name and address
  • Owner's Certificate of Insurance and Vehicle License (issued by ICBC)
  • Other documents sufficient to satisfy the Chief Election Officer

About Elections and Electoral Approval

 Local Government Elections
 The Local Government Act, Part 3 establishes the regulations for elections, electors, candidates and any of their agents, and chief electoral officers. Local Government Elections are held every four years. The last was held October 20, 2018; the next will be held Saturday, October 15, 2022. During the four year term, if a member of Council is no longer able to fulfill their duties and resigns their post, the Local Government Act allows for a by-election to be held prior to the next election date, if required.

Additional procedures and regulations are also outlined in the City of West Kelowna Local Government Election Bylaw 0248.

In the case of a Local Government Election or a by-election, the City of West Kelowna must follow specified guidelines to advertise the process to eligible candidates and voters. In addition to these specified guidelines, the City of West Kelowna makes information available: on its website; through eNotifications to subscribers; via quarterly newsletters in utility bills; on its social media pages - Facebook, Instagram and Twitter; and, through distribution of public service announcements and/or news releases media sources.

 Alternative Approval Processes

BC's Community Charter allows local governments to use an Alternative Approval Process (AAP) as one means of seeking voter assent on a proposal, most commonly in matters involving long-term borrowing. An AAP is an alternative to a referendum, which is costlier to taxpayers and involves a lengthier process. The AAP allows voters 30 days to submit an elector response form in opposition to the local government's proposal. If 10% or more of eligible voters submit forms indicating their opposition to the proposal, then elector assent is not obtained and the AAP fails.

The City of West Kelowna is required to follow specified guidelines to advertise the AAP process to eligible voters. In addition to these specified guidelines, the City of West Kelowna also makes information available: on its website; through eNotifications to subscribers; via quarterly newsletters in utility bills, if timing permits; on its social media pages - Facebook, Instagram and Twitter; and, through distribution of public service announcements and/or news releases to media.

 Referendums
A referendum is a popular vote used to obtain electoral approval on a matter being proposed by a legislative body. Typically voters are presented with a single question on a matter in which the legislative body has the authority to act.

A referendum can be binding or non-binding depending on the matter at hand. If a referendum is binding, a government must carry out the decision of the electorate; if a referendum is non-binding, the government can take the ruling of the electorate into consideration in making its decision.

In British Columbia, a binding referendum must be held on a significant issue such as incorporation, certain bylaws and disposal of public assets. A non-binding referendum can be held on important matters where a municipal council may be interested in knowing how a community stands on a particular issue and where the results may be helpful to elected officials looking to make a final decision on a pressing or polarizing issue.

Assent of the electors is obtained when a majority of valid votes are found to be in favour of the bylaw or question. If the bylaw or question fails to obtain the majority assent of the electors, then a local government must wait six months before it is permitted to hold another referendum on the same question or bylaw, provided that the Province of British Columbia approves.
